3. Andalusian Tourism Registry (RTA)

In accordance with Decree 143/2014, of October 21, regulating the organization and operation of the Andalusian Tourism Registry, and in compliance with Law 13/2011, of December 23, on Tourism of Andalusia:

Classification: Tourism operator. Sendalpina acts solely as an intermediary connecting the client with independent mountain guides; it does not directly organize or carry out the activities (see Section 7 and the Terms and Conditions of Contract).

4. Insurance and Guarantees

Given Sendalpina's intermediary nature, the insurance coverages relating to the performance of the mountain activities correspond entirely to the independent mountain guide contracted by the client, and not to the owner of this website.

4.1. Public Liability Insurance of the activity

Each independent mountain guide is required to maintain their own valid Public Liability insurance policy specific to active tourism activities, in accordance with Decree 20/2002, of January 29, on Rural and Active Tourism of Andalusia. The client can and should request from the guide proof of such coverage and its validity before the activity begins.

4.2. Accident and Assistance Insurance

Coverage for accidents, rescue, medical assistance and repatriation during the activity corresponds to the independent guide and/or the client, as agreed between them. Sendalpina does not contract, manage or guarantee such coverage.

5. Intellectual and Industrial Property

The website www.sendalpina.com, including but not limited to its programming, editing, compilation and other elements necessary for its operation, designs, logos, text and/or graphics are the property of the owner or have express license or authorization from the authors.

All contents of the website are duly protected by intellectual and industrial property regulations, as well as registered in the corresponding public registries.

Total or partial reproduction of the contents is expressly prohibited without the express written authorization of the owner. Any unauthorized use by the owner will be considered a serious breach of intellectual or industrial property rights.

6. Terms of Website Use

Accessing and using this website confers the status of user, and it is understood that the user fully and unreservedly accepts all provisions included in this Legal Notice from the moment they access the portal.

The user undertakes to:

  • Make appropriate and lawful use of the website and its contents, in accordance with applicable legislation and these terms.
  • Not use the website for illicit purposes or effects contrary to those established, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload or deteriorate the site.
  • Not introduce or spread computer viruses or any other physical or logical system that is likely to cause damage to the physical or logical systems of the owner, its suppliers or third parties.

7. Liability and Limitations

7.1. Liability for information

The owner is not responsible for damages of any nature that may be caused by errors or omissions in the contents, lack of availability of the portal or transmission of viruses or malicious programs, despite having adopted all necessary technical measures to prevent it.

7.2. Liability in mountain activities

Mountain and outdoor activities involve inherent risks. Sendalpina acts solely as an intermediary connecting the client with independent mountain guides; it does not organize or carry out the activities and does not assume their technical direction or safety, which are the exclusive responsibility of the contracted guide. In its capacity as intermediary, the owner:

  • Provides general prior information about the activities and verifies, on a documentary basis and at the time of the guide's onboarding, the existence of enabling qualifications and insurance, without this implying any guarantee regarding the performance of the service.
  • Will provide prior necessary information on difficulties, risks, required equipment and necessary physical conditions.
  • Reserves the right to modify or suspend activities for safety reasons, adverse weather conditions or when the participant's physical or mental state is not adequate.
  • Is not responsible for damages resulting from the user's failure to comply with safety rules and guide instructions.

8. External Links

In the event that the website contains links or hyperlinks to other Internet sites, the owner does not exercise any type of control over such sites and contents.

Under no circumstances will the owner assume any responsibility for the contents of any link belonging to an external site, nor guarantee the technical availability, quality, reliability, accuracy, breadth, veracity, validity and constitutionality of any material or information contained in any of said hyperlinks or other Internet sites.

The establishment of any link does not necessarily imply the existence of relations between the owner and the owner of the linked site, nor the knowledge and acceptance of the contents or services offered on the linked sites.

10. Applicable Legislation and Jurisdiction

The relationship between the owner and the user is governed by current Spanish legislation and any controversy will be submitted to the Courts and Tribunals of the city of Málaga, unless applicable legislation establishes otherwise.

  • Law 13/2011, of December 23, on Tourism of Andalusia.

  • Royal Decree 702/2019, regulating vocational sports education.
  • Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

11. Modifications

The owner reserves the right to modify this Legal Notice to adapt it to legislative or jurisprudential developments, as well as industry practices. These modifications will be notified through this same page.
